Noida Authorities final decision on banning the approval of building was revised by Allahabad High Court

Allahabad High Court put aside the order prohibiting agreement of  the approval of the building’s revised plan and registration of apartments and Sports City by Noida Authority in their 201st board meeting, which was planned back in 2014. It was decided that the project would be built on the Noida- Greater Expressway Highway. 

From 2014 to 2022, Ace took six years to revise their plan 

In 2014, in Noida, a group of companies led by Lotus Green Construction Pvt Ltd allotted 12 lakh sqm of land in sector 150 to develop Sports City. Between the overall total land, Ace was supposed to get 60,000 sqm for the remaining residential projects. 

Due to lease deeds executed in 2015, only some part of the land was acquired because of protests by farmers. From the 12 lakh sqm, only 3 lakh was given to Sports City, and 30,000 sqm was offered for residential projects. 

Due to needing complete land, Ace couldn’t state a constitution within 30,000, so they waited till 2022 and returned with the revised plan, but Noida authority refused the project. 

Later, in 2023, Noida Authorities filed a petition to pay them Rs. 79 crore in land expenses by banning the map revision. 

  • As per the reports, Ace told the court that they had already paid an amount of Rs. 134.37 crore rupees in opposition to the land , which costs Rs.116.40 crore. 
  • As per the reports, Ace, along with 11 other developers in the world, has also filed a writ in the high court to get relief from the ban by the Noida authority on the prohibition of sale and purchase. In addition to this, more than 10 thousand homebuyers will get relief. 
  • Lotus Green Pvt Ltd also filed two petitions in 2017 and carried them to 2019 as they could not complete their work due to villagers’ protests. 

What did the Allahabad High Court say?

The high court order said that they viewed the suppliant company as not able to complete the project on time. Double bench of Justice Ashutosh Srivastava and Justice Pritinker Diwaker said that the petitioner company is also qualified for the benefit of Zero period from its assigned date till today. 

During the last hearing, the Allahabad courts asked the Noida authority to take a call on the petitions filed and facilitate the availability of the land to the developers as well as the buyer. In addition, the respondent authority was also addressed to accept the revised plan related to sector 150. 

Conclusion

Approval of the revised building plan and registration of apartments and Sports City by Noida Authority in their 201st board was banned. Ace paid Rs.134.37 crore rupees against the premium land, which costs Rs.116.40 crore. Due to this, Ace and 11 other developers filed a petition against Noida’s authority. Recently, an order was released by the Allahabad High Court to remove the ban and consider the revised plan related to sector 150.
